Dipoll Terms of Service
Last updated: [DATE] · Effective: [DATE]
These Terms of Service ("Terms") are a binding agreement between you and [LEGAL ENTITY NAME]
("Dipoll," "we," "us") governing your use of the Dipoll app and https://dipoll.org (together,
the "Service"). By creating an account or using the Service, you agree to these Terms and to our
Privacy Policy and Community Guidelines. If
you do not agree, do not use the Service.
1. Accounts & eligibility
Age. You must be at least 16 years old to use Dipoll. By creating an account, you
represent that you are 16 or older. If you are under the age of majority in your jurisdiction
but at least 16, you represent that a parent or legal guardian has reviewed and agreed to these
Terms on your behalf where required by law.
Signup requires an in-app affirmation that you are 16 or older (checkbox). Dipoll does not
independently verify government ID age; false affirmations may result in account removal.
Registration. You must provide an accurate username and email and verify your email and
phone number. You are responsible for your credentials and all activity under your account.
One person per account; do not impersonate others.
Suspension/termination by you. You may stop using the Service and delete your account at
any time from within the app (Account → Delete). Deletion removes your account per our
Privacy Policy.
2. The Service
Dipoll lets you create polls (yes/no, single/multiple choice, rating, slider, ranking formats
such as Keep-Trade-Cut, free response, image polls, and more), vote, comment, react, send direct
and group messages, follow other users, and view aggregated results by geography and
demographics. Features may change, launch, or be discontinued over time.
3. Your content and the license you grant
"User Content" means anything you submit: polls, options, images, votes, comments, messages,
profile information, and reports.
- You keep ownership of your User Content.
- License to us. You grant Dipoll a worldwide, non-exclusive, royalty-free, sublicensable,
transferable license to host, store, reproduce, modify (e.g. resize/transcode images), adapt,
publish, publicly display, and distribute your User Content solely to operate, provide, and
promote the Service, including displaying poll results and geographic/demographic
aggregates. This license ends when you delete the content or your account, except (a) for
content others have shared or reposted, (b) residual backup copies for a limited time, and
(c) aggregated/de-identified results (e.g. vote tallies) that no longer identify you. - Your responsibility. You represent that you have the rights to submit your User Content and
that it does not violate these Terms, our Community Guidelines, or the law. - Aggregated data. Poll results are shown to other users in aggregate, including by location
and demographic slices you and other voters chose to provide. Do not post content you do not
want analyzed and displayed this way.
4. Acceptable use
You agree not to, and not to help others:
- Post content that is illegal, hateful, harassing, threatening, sexually explicit involving
minors, or that incites violence (see Community Guidelines).
- Harass, bully, dox, impersonate, or infringe others' intellectual property or privacy.
- Spam, manipulate votes or engagement, run bots, scrape, or create fake/duplicate accounts.
- Attempt to break, overload, reverse engineer, or gain unauthorized access to the Service,
other accounts, or non-public/administrative surfaces.
- Misuse location, messaging, or demographic features to target or harm others.
5. Moderation, reporting & enforcement
- Reporting & blocking. You can report polls and block users from within the app. We
encourage you to use these tools. - Our rights. We may review, remove, edit visibility of, or restrict any content, and we may
warn, suspend, or terminate accounts that violate these Terms or the Community Guidelines, with
or without notice where appropriate. We operate an internal moderation surface ("RNV") whose
actions are logged. - No obligation to pre-screen. We do not review all content in advance and are not
responsible for User Content, but we may act on it. - Appeals. [Describe appeal/contact path, e.g. email [SUPPORT EMAIL].] [Owner to define.]
6. Direct messages
DMs and group chats are private between participants but are not end-to-end encrypted. We may
access message content as needed to operate the Service, respond to reports, comply with law, or
protect safety. Do not use DMs for unlawful activity.
7. Intellectual property
The Service itself — software, design, logos, and "Dipoll" branding — is owned by us or our
licensors and protected by law. We grant you a limited, revocable, non-transferable license to
use the app for personal, non-commercial purposes under these Terms. All rights not granted are
reserved.
8. Third-party services
The Service integrates third parties (e.g. Twilio, Apple/Google push and sign-in, Google Maps,
Google AI, AWS hosting). Their terms and privacy practices govern their portions; we are not
responsible for third-party services.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Poll results are user-generated and are not scientific surveys, professional advice, or
statements of fact by Dipoll. We do not guarantee uninterrupted or error-free operation.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIPOLL AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED [CAP AMOUNT — e.g. the
greater of USD $100 or amounts you paid us in the prior 12 months]. Some jurisdictions do not
allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You will indemnify and hold harmless Dipoll from claims arising out of your User Content, your
use of the Service, or your violation of these Terms or the law, to the extent permitted by law.
12. Changes & termination
We may modify the Service or these Terms; material changes will be posted with an updated date
and, where appropriate, surfaced in-app. Continued use after changes means you accept them. We
may suspend or terminate the Service or your access as described in §5.
13. Governing law & disputes
These Terms are governed by the laws of [GOVERNING LAW / STATE / COUNTRY], without regard to
conflict-of-laws rules. [ARBITRATION CLAUSE — optional; if used, include a clear description,
class-action waiver where permitted, and any consumer carve-outs and opt-out mechanism. Attorney
to draft and confirm enforceability in target jurisdictions.] Absent an enforceable arbitration
clause, disputes will be resolved in the courts of [VENUE].
14. Apple / Google app-store terms
If you obtained the app from the Apple App Store or Google Play, you also agree to that store's
terms. For Apple: these Terms are between you and Dipoll, not Apple; Apple is not responsible for
the app or its content; and Apple is a third-party beneficiary entitled to enforce these Terms.
[Attorney to include the full Apple "Licensed Application End User License Agreement"
required clauses if not relying on Apple's standard EULA.]

If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision
is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor.
